A legal disclaimer

1. Introduction

These Terms and Conditions (“Terms”) govern the use of services provided by LumberJake LLC (“Contractor,” “we,” “our,” or “us”). By hiring our services, the Client (“you”) agrees to these Terms.

2. Services

  • Services include tree removal, stump grinding, and optional debris haul-away as described in your estimate.

  • We will contact utility companies before work begins to flag underground utilities.

  • Services do not include hazardous tree removals near homes, power lines, or structures unless explicitly agreed upon in writing.

3. Client Responsibilities

You agree to:

  • Provide safe and clear access to the work site.

  • Disclose the presence of underground systems (sprinklers, septic, private utility lines) that may not be flagged by utility companies.

  • Obtain any necessary permits, unless otherwise agreed in writing.

4. Pricing & Payment

  • Estimates are valid for 30 days unless otherwise stated.

  • Payment is due upon completion of work unless otherwise agreed in writing.

  • A deposit may be required before scheduling work.

5. Cancellations & Rescheduling

  • Jobs may be rescheduled due to weather, unsafe conditions, or utility clearance delays.

  • If you cancel less than 24 hours before scheduled work, a cancellation fee may apply.

6. Liability

  • We are insured and will perform services in a safe and professional manner.

  • We are not liable for damage to unmarked underground systems or items not disclosed by the Client.

  • Tree removal and stump grinding carry inherent risks; we are not liable for incidental damages if work is performed within agreed scope and safety practices.

7. Haul-Away & Debris

  • Unless otherwise agreed, debris will be hauled away.

  • Stump grinding debris (wood chips, soil) will remain on-site unless haul-away is specifically contracted.

8. Warranty Disclaimer

  • Stump grinding does not remove the full root system, and regrowth or settling may occur.

  • We make no guarantees against regrowth, underground decay, or natural changes after removal.

9. Photography & Marketing

We may take before-and-after photos of work for documentation and marketing. Identifiable features of your property will not be shared without consent.

10. Third-Party Content & Links

Our website may include links or embedded content from third parties (e.g., Google Maps, YouTube). We are not responsible for the accessibility or practices of those third parties.

11. Dispute Resolution

Any disputes must first be submitted to mediation in the State of Minnesota before further legal action is pursued.

12. Governing Law

These Terms are governed by the laws of the State of Minnesota.

13. Changes to Terms

We may update these Terms from time to time. Updated versions will be posted on our website.
